Part 1 — Preliminary

2. Interpretation

(1)

(2)

For the purposes of this Regulation, an application for registration is an application under section 39(1) of the Ordinance for registration as—

(a)

a registered skilled worker for one designated trade division;

(b)

a registered skilled worker (provisional) for one designated trade division;

(c)

a registered semi-skilled worker for one designated trade division;

(d)

a registered semi-skilled worker (provisional) for one designated trade division; or

(e)

a registered general worker.

(3)

For the purposes of this Regulation, an application for renewal of registration is an application under section 44(5) of the Ordinance for renewal of registration as—

(a)

a registered skilled worker for one designated trade division;

(b)

a registered semi-skilled worker for one designated trade division; or

(c)

a registered general worker.

Part 2 — Fees for Application for Registration

3. Application fees for registration: general

Subject to sections 3A, 4 and 5, the fee payable for an application for registration is $100.

3A. Application fees for registration: registration periods of not more than 48 months

(1)

The fee payable for an application for registration for a registration period specified in column 1 of Schedule 1 is the percentage of the general application fee specified in column 2 of that Schedule opposite the period.

(2)

In this section—

general application fee (一般申請費) means the fee prescribed by section 3; registration period (註冊期), in relation to a registration, means the period beginning on the date of the registration and expiring on the date specified under section 44(1) of the Ordinance for the registration.

4. Application fees for registration: applicant is a registered construction worker

No fee is payable for an application for registration if the person making the application is already a registered construction worker.

5. Application fees for registration: specific designated trade divisions

The fee payable for an application for registration is one-half of the fee prescribed under section 3 or 3A if—

(a)

it is an application for registration as a registered skilled worker or registered semi-skilled worker for a designated trade division; and

(b)

a qualification or requirement is set out in column 6 of Schedule 1 to the Ordinance opposite the trade division.

Part 3 — Other Fees

6. Application fees for renewal of registration: general

Subject to sections 6A and 6B, the fee payable for an application for renewal of registration is $100.

6A. Application fees for renewal of registration: renewal periods of not more than 48 months

(1)

The fee payable for an application for renewal of registration for a renewal period specified in column 1 of Schedule 2 is the percentage of the general renewal fee specified in column 2 of that Schedule opposite the period.

(2)

In this section—

general renewal fee (一般續期費) means the fee prescribed by section 6; renewal period (續期期間), in relation to the renewal of a registration, means the period—(a)beginning on the relevant date as defined by paragraph (b), (c) or (d) of the definition of relevant date in section 44(10) of the Ordinance; and (b)expiring on the date specified under section 44(1) of the Ordinance for the registration as renewed.

6B. Application fees for renewal of registration: specific designated trade divisions

The fee payable for an application for renewal of registration is one-half of the fee prescribed under section 6 or 6A if—

(a)

it is an application for renewal of registration as a registered skilled worker or registered semi-skilled worker for a designated trade division; and

(b)

a qualification or requirement is set out in column 6 of Schedule 1 to the Ordinance opposite the trade division.

7. Application fees: replacement of registration card

The fee payable in respect of an application under section 46(8) or (9) of the Ordinance is $100.

8. Fees for the purpose of a notice of appeal

The fee payable in respect of a notice of appeal for the purposes of section 52(4)(b) of the Ordinance is $30.

8A. Fee for assessment under section 40A(8) of Ordinance

(1)

The fee payable under section 40A(8) of the Ordinance for one assessment referred to in section 40A(1)(b)(ii) of the Ordinance is $50.

(2)

The Council is to refund in full a fee paid under subsection (1) in connection with a person’s application for registration if—

(a)

the application is made within 12 months beginning on the commencement date* of section 40A of the Ordinance; and

(b)

the person passes the assessment for which the fee was paid.

Part 4 — Waiver of Fees

9. Waiver of application fees for registration

(1)

This section applies if—

(a)

a person makes 2 or more applications for registration at the same time; and (L.N. 205 of 2005)

(b)

a fee is prescribed for each application under section 3, 3A or 5. (L.N. 15 of 2015)

(2)

The fee payable in respect of each application, other than the following, is waived—

(a)

in the case where the fee so prescribed for each application is of the same amount, the fee payable in respect of any one application specified by the Registrar;

(b)

in the case where the fee so prescribed for each application is not of the same amount— (L.N. 205 of 2005)

(i)

the fee payable in respect of the application for which the fee so prescribed is of the lower or lowest amount; or

(ii)

if there are 2 or more such applications, the fee payable in respect of any one of such applications specified by the Registrar.

10. Waiver of application fees for renewal of registration

(1)

This section applies if—

(a)

a person makes 2 or more applications for renewal of his registration at the same time; and (L.N. 205 of 2005)

(b)

a fee is prescribed for each application under section 6, 6A or 6B. (L.N. 15 of 2015)

(2)

The fee payable in respect of each application, other than the following, is waived—

(a)

in the case where the fee so prescribed for each application is of the same amount, the fee payable in respect of any one application specified by the Registrar;

(b)

in the case where the fee so prescribed for each application is not of the same amount— (L.N. 205 of 2005)

(i)

the fee payable in respect of the application for which the fee so prescribed is of the lower or lowest amount; or

(ii)

if there are 2 or more such applications, the fee payable in respect of any one of such applications specified by the Registrar.
