Pilotage (Dues) Order

This order may be cited as the Pilotage (Dues) Order.
In this Order—
pilot boarding station (領港員登船區) has the meaning given by section 10A of the Ordinance.The pilotage dues shall be those specified in the Schedule.
A licensed pilot who is carried without his consent beyond Hong Kong or beyond the point outside Hong Kong to which he was engaged to pilot a ship shall be maintained while he is on the ship in the same way as an officer of the ship and shall be paid, in addition to the pilotage dues—
reasonable travelling expenses (including, if necessary, first class air fares) to enable him to return to Hong Kong if he leaves the ship outside Hong Kong; and (L.N. 432 of 1984)

The additional fee specified in subsection (1)(b) is payable for the day on which the ship leaves Hong Kong or passes beyond the point outside Hong Kong to which the licensed pilot was engaged to pilot the ship and for each day until, and inclusive of, the day on which the ship returns to Hong Kong, or, if the licensed pilot leaves the ship outside Hong Kong, for each day which is reasonably required for him to return to Hong Kong inclusive of the day of return. For every ship piloted, a pilotage due of $5,150 plus— (L.N. 111 of 2005; L.N. 70 of 2008; L.N. 174 of 2011; L.N. 88 of 2016; 12 of 2022 s. 16)
for ships having a gross tonnage of less than 40 000 tons, $0.0768 per ton of the ship’s gross tonnage; (L.N. 234 of 2002; L.N. 70 of 2008)
for ships having a gross tonnage of or above 40 000 tons but not exceeding 80 000 tons, $0.0712 per ton of the ship’s gross tonnage or $3,072, whichever is the greater; (L.N. 234 of 2002; L.N. 111 of 2005; L.N. 70 of 2008)
for ships having a gross tonnage exceeding 80 000 tons but not exceeding 120 000 tons, $0.0685 per ton of the ship’s gross tonnage or $5,696, whichever is the greater; (L.N. 234 of 2002; L.N. 111 of 2005; L.N. 70 of 2008)
for ships having a gross tonnage exceeding 120 000 tons but not exceeding 140 000 tons, $0.0603 per ton of the ship’s gross tonnage or $8,220, whichever is the greater; or (L.N. 88 of 2016)
for ships having a gross tonnage exceeding 140 000 tons, $8,448. (L.N. 70 of 2008)
Notes: (a) The pilotage dues specified in this Part include all costs incurred by a pilot in travelling to and from a ship.
Pilotage dues for pilotage into the harbour include anchoring in the quarantine anchorage and moving a ship from such anchorage to a buoy, wharf or other anchorage.
The pilotage dues payable by warships under this Part shall be calculated on the basis of displacement tonnage instead of gross tonnage. (2 of 2013 s. 13)
An additional pilotage due of $1,400 per hour or part thereof (after the first hour) shall be payable for any pilotage service performed in the movement of oil rigs.
An additional pilotage due equal to 100% overall of the standard pilotage dues shall be payable for any pilotage service performed in the movement of dead ships as defined in the Shipping and Port Control Ordinance (Cap. 313).
An additional pilotage due equal to 100% overall of the standard pilotage dues shall be payable for any pilotage service if the whole or any part thereof is performed while any tropical cyclone warning signal other than the Standby Signal No. 1 is issued. (L.N. 111 of 2005)
An additional pilotage due of $1,482 per half an hour or part thereof shall be payable for any pilotage service performed, where a pilot is required to proceed outwards beyond a pilot boarding station, from the time the ship passes a pilot boarding station outwards until the ship passes a pilot boarding station inwards. An additional pilotage due of $2,191 shall be payable for any pilotage service performed, where a pilot is required to board a ship or disembark from a ship off Ngan Chau or at the west of Lamma Island. An additional pilotage due of $3,070 shall be payable for any pilotage service performed, where a pilot is required to board a ship or disembark from a ship west of a straight line drawn from Pearl Island to East Brother Island. An additional pilotage due of $1,425 shall be payable for any pilotage service performed, where a pilot is required to board a ship or disembark from a ship north of a straight line drawn from Black Point to Lung Kwu Chau Light. (L.N. 111 of 2005; L.N. 88 of 2016; 12 of 2022 s. 16)
An additional pilotage due of $4,605 is payable for any pilotage service performed if a pilot is required to board, or disembark from, a ship in Tolo Harbour. (L.N. 146 of 2019; 12 of 2022 s. 16)
An additional pilotage due of $4,230 is payable for any pilotage service performed if a pilot is required to board, or disembark from, a ship at the pilot boarding station described in item 6 of Schedule 2 to the Ordinance (area off Ping Chau in Mirs Bay). (L.N. 146 of 2019; L.N. 1 of 2025)
An additional pilotage due of $7,400 is payable for any pilotage service performed if a pilot is required to board, or disembark from, a ship at— (L.N. 1 of 2025)
the pilot boarding station described in item 7 of Schedule 2 to the Ordinance (area off Crooked Island in Mirs Bay); or
the pilot boarding station described in item 8 of Schedule 2 to the Ordinance (area off Shek Ngau Chau in Mirs Bay). (L.N. 146 of 2019)
Where a pilot is detained there shall be payable for such detention an additional pilotage due of $1,720 per half an hour or part thereof for the first hour, $1,720 for the second hour or part thereof and $1,720 per hour or part thereof for any further period of detention. An additional pilotage due equal to 50% overall of the standard pilotage dues is payable for any pilotage service that is provided—
if a pilot is required to board, or disembark from, a ship in Mirs Bay—on notice of less than 5 hours; or
if a pilot is required to board, or disembark from, a ship elsewhere—on notice of less than 3 hours. (L.N. 146 of 2019)

If the engagement of a pilot is cancelled—
within 3 hours before the last stated time of a requirement for pilotage services in Mirs Bay;
within 1.5 hours before the last stated time of a requirement for pilotage services in Tolo Harbour or at the west of East Brother Island; or
within 1 hour before the last stated time of a requirement for pilotage services elsewhere,
a pilotage due of $5,150 is payable. (L.N. 146 of 2019)
If the engagement of a pilot is altered—
within 3 to 5 hours before the last stated time of a requirement for pilotage services in Mirs Bay; or
within 1 to 3 hours before the last stated time of a requirement for pilotage services elsewhere,
an additional pilotage due of $349 is payable. (L.N. 146 of 2019)
If the engagement of a pilot is altered more than twice then an additional pilotage due of $349 shall be payable for the third and each subsequent alteration.
