In this Regulation, unless the context otherwise requires— (78 of 1999 s. 7)
abattoir (屠場) means an abattoir specified in Schedule 1; authorized officer (獲授權人員) means—(a)a health inspector; and(b)a public officer appointed under section 3(1); (L.N. 279 of 1991; 78 of 1999 s. 7) carcass (屠體) means the body of a dead food animal; (L.N. 210 of 1972; L.N. 279 of 1991) Director (署長) means the Director of Food and Environmental Hygiene; (78 of 1999 s. 7) dressed carcass (去臟的屠體) means, in respect of a bovine animal, sheep or soliped, a carcass from which the offal, hide and head have been removed and, in respect of a swine or goat, a carcass from which the offal has been removed; (L.N. 279 of 1991) entry permit (入場許可證) means an entry permit issued under section 34(1); (L.N. 279 of 1991; 78 of 1999 s. 7) food animal (食用牲口) means live bovine animal, swine, goat, sheep or soliped; (L.N. 279 of 1991) lairage (牲口欄) means a part of an abattoir which is used for the confinement of food animals; (L.N. 279 of 1991) licensed slaughterhouse (持牌屠房) means a slaughterhouse in respect of which a licence has been issued under section 9 of the Slaughterhouses Regulation (Cap. 132 sub. leg. BU); (L.N. 329 of 1990; 78 of 1999 s. 7; E.R. 3 of 2022) manager (經理) means a person appointed by the Director to manage or assist in the management of an abattoir; (L.N. 143 of 1976) offal (什臟) means any part of a carcass which is removed therefrom during the process of dressing it, but does not include the hide or skin; (L.N. 210 of 1972; L.N. 279 of 1991) waiting lairage (待宰欄) means a lairage in which food animals are confined while awaiting slaughter. slaughter, or cause or permit to be slaughtered, any food animal for human consumption in any place except an abattoir or a licensed slaughterhouse; (L.N. 329 of 1990)
slaughter, or cause or permit to be slaughtered, any food animal for human consumption otherwise than in accordance with this Regulation;
dress, or cause or permit to be dressed, the carcass of any food animal for human consumption otherwise than in accordance with this Regulation.
The Director may authorize in writing the slaughtering or dressing of any food animal for human consumption in a place other than in an abattoir or a licensed slaughterhouse, in such manner and subject to such conditions as he thinks fit. (L.N. 279 of 1991)
Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable to a fine at level 5 and to imprisonment for 6 months, and in the case of a continuing offence to a further daily fine of $600. (L.N. 284 of 1987; L.N. 177 of 1996)
The Director may appoint any public officer to be an authorized officer in an abattoir for the purposes of such of this Regulation as he may specify.
In the exercise of his powers and functions under this Regulation an authorized officer shall be subject to the directions of the manager of the abattoir.
There shall be payable by every person to whom any services have been provided in an abattoir the prescribed fee. (L.N. 179 of 1995)
The manager may, if there is a prescribed fee for that purpose, nominate that a night will be for night slaughter. (L.N. 345 of 1988)
If a person brings a food animal into an abattoir to be slaughtered before 8 a.m. on the morning after a night nominated for night slaughter, the person shall pay the prescribed fee, if any, for night slaughter. (L.N. 345 of 1988; L.N. 279 of 1991)
The manager of an abattoir may fix the hours during which it shall be open each day for the admission or slaughter of food animals.
Notwithstanding any entry permit issued under section 34 or any pass issued under section 35, if in the opinion of the manager of an abattoir it is expedient to do so for its efficient operation or maintenance, he may by order in writing prohibit, either permanently or for such period as he thinks fit, the entry of persons without his consent to any part of the abattoir specified in the order. A copy of an order under subsection (1) shall be posted in a conspicuous place outside the part of the abattoir to which it relates.
Any person who enters a part of an abattoir in contravention of an order under subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine at level 4 and to imprisonment for 6 months. (L.N. 284 of 1987; L.N. 279 of 1991; L.N. 177 of 1996)
No person shall bring into or keep in an abattoir any animal other than a food animal except with the consent of the manager. (L.N. 279 of 1991)
Any person who contravenes subsection (1) shall be guilty of an offence. (78 of 1999 s. 7)
No person shall bring into or keep in an abattoir—
any animal other than a food animal; and
any food animal for any purpose other than slaughter for human consumption, except with the permission of the manager. (L.N. 279 of 1991)
An authorized officer may require any food animal admitted to an abattoir to be examined to ascertain whether it is fit for human consumption when slaughtered. (L.N. 279 of 1991)
Any person who brings a food animal into an abattoir in contravention of subsection (1) shall be guilty of an offence. (78 of 1999 s. 7)
Subject to subsection (2), no person shall bring into an abattoir any carcass.
A person may bring a carcass of a food animal into an abattoir for examination under section 27 if—
the carcass has been bled; and
it is accompanied by a certificate from an authorized officer and, in the case of soliped sent in by the Hong Kong Jockey Club, by a Veterinary Officer appointed by that Club stating— (59 of 2000 s. 3)
the exact time and date of killing and bleeding;
the reason for the slaughter of the food animal;
that, to his knowledge, the food animal was not slaughtered by reason of disease or is not for any other cause unfit for human consumption; and
that, to his knowledge, no drug which could affect the fitness of the carcass (including the offal) for human consumption was administered to the food animal before it was slaughtered.
A person who contravenes subsection (1) commits an offence.
No person shall, except at the direction or with the consent in writing of the manager, remove alive from an abattoir any food animal which has been admitted to the abattoir in accordance with this Regulation. (L.N. 33 of 1975; L.N. 279 of 1991)
Any person who contravenes subsection (1) shall be guilty of an offence. (L.N. 210 of 1972)
The manager of an abattoir may refuse to admit to the abattoir a food animal if in his opinion there is insufficient accommodation available in the abattoir for the food animal.
When a food animal is admitted to an abattoir, a statement in the prescribed form in respect of the food animal shall be delivered to the manager within 24 hours thereafter. (See Schedule 3, Form 1)
If a statement is not delivered to the manager in accordance with subsection (1), then— (78 of 1999 s. 7)
the owner of the food animal; and
the person who was in charge of the food animal at the time of its admission,
shall be guilty of an offence.
An authorized officer may affix to a food animal which has been admitted to an abattoir a tag or mark for the purpose of recording its admission and disposal in the abattoir.
Any person in an abattoir who, without the consent of the manager, removes, alters or interferes with a tag or mark affixed to a food animal under subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine at level 4 and to imprisonment for 6 months. A manager may in writing direct—
the owner of a food animal in an abattoir; or
any person appearing to the manager to be in charge of a food animal in an abattoir,
to remove the food animal from the abattoir to a licensed slaughterhouse for slaughter. (L.N. 329 of 1990)
Any person who fails to comply with a direction given to him by a manager under subsection (1) shall be guilty of an offence. (78 of 1999 s. 7)
An authorized officer may give to—
the owner of a food animal in an abattoir; and
any person appearing to the authorized officer to be in charge of a food animal in an abattoir,
such directions as he thinks fit as to—
the placing or tying of the food animal in any stall, pen, or lairage in the abattoir; and
the movement of the food animal from any place to any other place in the abattoir.
An authorized officer may give such directions he thinks fit as to—
the priority; and
the number,
of food animals admitted to any part of an abattoir. (L.N. 33 of 1975)
Any person who fails to comply with a direction given to him under subsection (1) or (1A) shall be guilty of an offence. (L.N. 33 of 1975; 78 of 1999 s. 7)
Every food animal which has been admitted to an abattoir in accordance with this Regulation shall be delivered within 5 days thereafter to a waiting lairage to be slaughtered unless previously removed under section 9. (L.N. 33 of 1975)
The manager may if he thinks fit extend the time limit referred to in paragraph (a) in respect of any food animal.
Any person who, being the owner or person in charge of a food animal, fails to comply with subsection (1) shall be guilty of an offence.
In the event of a contravention of subsection (1), the manager of the abattoir may cause the food animal to be delivered to a waiting lairage and thereafter slaughtered.
If an authorized officer has reason to suspect that a food animal admitted to an abattoir is suffering from disease or injury, he may cause the food animal to be segregated from the other food animals in the abattoir and, if he thinks it is necessary to do so, may cause the food animal to be slaughtered.
When a food animal in an abattoir is slaughtered under section 14(3) or 15, the manager shall forthwith give notice of the fact to—
the owner of the food animal; or
the person who appeared to the manager to be in charge of the food animal immediately prior to the time when the food animal was received into a waiting lairage or segregated, as the case may be.
A manager shall maintain for his abattoir a register, to be known as the owners register, in which he shall register the names of owners of food animals delivered or to be delivered for slaughter at the abattoir. (L.N. 279 of 1991)
The owners register shall consist of—
Part I, which shall contain the names and particulars of persons whose registration, subject to this Regulation, is permanent; and (78 of 1999 s. 7)
Part II, which shall contain the names and particulars of persons who are registered temporarily or in respect of a specified number of food animals. (L.N. 279 of 1991)
The manager shall assign a registration number to each person registered in the owners register.
The particulars to be entered in Part I of the owners register of a person are—
his registration number;
the date of his registration;
his name in full in English or, in the case of a corporation, the name of the corporation;
his name in full in Chinese, if any, or, in the case of a corporation, the name of the corporation;
his business name;
the business carried on by him;
the address of each of the premises at which he carries on the business.
An application for registration in Part I of the owners register shall be in Form 2 in Schedule 3.
An applicant for registration in Part I of the owners register shall produce for inspection by the manager—
a licence to the applicant to carry on a food business in which meat is sold or prepared for human consumption issued under the Food Business Regulation (Cap. 132 sub. leg. X); (10 of 1986 s. 32)
a business registration certificate issued under section 6 of the Business Registration Ordinance (Cap. 310) in respect of a wholesale livestock business carried on by the applicant, or a copy of the certificate certified under section 19(1)(a) of that Ordinance or certified by the applicant; or (13 of 2010 s. 27)
a letting under section 6 of the Public Markets Regulation (Cap. 132 sub. leg. BO) of a stall in a public market enabling the applicant to carry on a business in which meat is sold or prepared for human consumption. (10 of 1986 s. 32)
On the receipt of an application under subsection (1) the manager may—
register the applicant in Part I of the owners register; or
notify the applicant of his refusal to register him.
The manager may, and if directed by the Director shall, register any person in Part II of the owners register.
The manager shall delete from the owners register the name of any person who—
fails to notify the manager in writing within 7 days of any change in the particulars of such person entered in the register; or
has not been issued with a receipt for any food animal admitted to a waiting lairage for a period of 3 months.
No person, not being a public officer, shall deliver a food animal to a waiting lairage unless—
the name of the owner of such food animal is entered on the owners register; and
the food animal has been marked with the registration number of the owner, or, if the food animal is a pig, has been marked with a tattooing instrument approved by the manager.
Any person who contravenes subsection (1) shall be guilty of an offence. (78 of 1999 s. 7)
If the owner of any food animal, dressed carcass or carcass in an abattoir is not known or cannot be found the manager may cause it to be detained until the owner is ascertained or found.
Where a food animal, dressed carcass or carcass is detained under subsection (1) and the manager is satisfied that the owner of the food animal, dressed carcass or carcass cannot be ascertained or found, he may cause it to be disposed of in such manner as he thinks fit. (78 of 1999 s. 7)
The manager of an abattoir shall cause to be posted daily in a conspicuous place in the vicinity of every waiting lairage therein a statement containing the name of every person in whose name any food animal was being held in the waiting lairage at the close of working hours on the previous day and the number of food animals then held for that person.
No persons shall have any claim whatsoever against the Director or any public officer in respect of the theft of a food animal from a waiting lairage unless a complaint in writing, and the receipt issued for the food animal under this Part, are lodged by the claimant with the manager within 48 hours after the posting of the first statement under subsection (1) in which the lost food animal is not included. Any person who removes a food animal from a waiting lairage otherwise than at the direction or with the consent in writing of an authorized officer shall be guilty of an offence.
Except with the permission of the manager no person in an abattoir shall—
slaughter or assist in the slaughtering of any food animal; or
take part in any process of the dressing, trimming, cutting, tying, washing or handling of a slaughtered food animal or any part thereof. (L.N. 33 of 1975)
Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine at level 4 and to imprisonment for 6 months. (L.N. 284 of 1987; L.N. 177 of 1996; 78 of 1999 s. 7)
The owner of a food animal which has been slaughtered in an abattoir shall be responsible for the collection from the abattoir of every part of the food animal specified in columns 1 and 2 of Schedule 4.
The owner of a food animal which has been slaughtered in an abattoir shall not be entitled to any part of the food animal specified in column 2 of Schedule 4 if the same part from another food animal of the same type is made available in its place for collection by the owner of the first-mentioned food animal.
Every part referred to in subsection (1) shall be available for collection from the abattoir by the owner, or by any person who has been approved by the manager as the agent of the owner, during working hours on the day on which the food animal has been slaughtered unless an alternative arrangement has been made between the owner and the manager as to the time of collection thereof.
If within the time specified in or arranged with the manager under subsection (2) the owner or his agent does not collect any part referred to in subsection (1), the manager may cause that part to be disposed of as he thinks fit.
The Director may, in such manner as he thinks fit, dispose of—
any blood, loose hairs and bristles, stomach contents and other waste matter; and
any ductless gland specified in Schedule 5,
obtained from a food animal slaughtered in an abattoir.
Subject to subsection (3), every food animal killed in an abattoir shall be slaughtered by means of a firearm or mechanically operated instrument in proper repair: (L.N. 279 of 1991; 78 of 1999 s. 7)Provided that any pig may be rendered unconscious with an electric stunner and then killed with a knife.
All firearms and instruments of slaughter used in an abattoir shall be—
of a type approved by the Director;
kept in the custody of the manager; and
used only by an officer authorized by the Director.
The Director may authorize the slaughter of any food animal in an abattoir by any method which accords with religious belief. (L.N. 279 of 1991)
A health inspector or a person authorized by the manager shall examine the carcass, or dressed carcass and offal of every food animal which is slaughtered in an abattoir or which is brought into an abattoir in compliance with section 8A(2) and shall detain the carcass or the whole or part of the dressed carcass or offal if in his opinion it is unfit for human consumption.
A health inspector or a person authorized by the manager may cause the carcass or the whole or part of the dressed carcass or offal detained under subsection (1) to be destroyed in such manner as he thinks fit.
If, after examining the dressed carcass of a food animal slaughtered in an abattoir, a health inspector or person authorized under section 27 is satisfied that it is fit for human consumption, he shall cause it to be marked with the appropriate mark specified in Schedule 6.
If, after examining the offal from a food animal slaughtered in an abattoir, a health inspector or person authorized under section 27 is satisfied that any part of the offal specified in Schedule 6 is fit for human consumption, he shall cause that part to be marked with the appropriate mark specified in Schedule 6.
No person shall—
remove any carcass, dressed carcass or offal from an abattoir without the consent of the manager; or (L.N. 210 of 1972)
except with the consent of the manager given under subsection (2) and in accordance with the conditions, if any, on which the consent is given, remove any carcass, dressed carcass or offal from the abattoir before such carcass, dressed carcass or offal has been examined under section 27, or when marking of a dressed carcass or offal is required under section 28 or 29, before such dressed carcass or offal has been so marked. The manager may give his consent on such conditions as he thinks fit to the removal of any carcass or offal from the abattoir before it has been examined under section 27 or, where it is required under section 28 or 29 to be marked, before it has been so marked.
A consent given under subsection (2) shall be in writing and shall specify the reason for which it is given.
Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine at level 5 and to imprisonment for 6 months. (L.N. 284 of 1987; L.N. 177 of 1996; L.N. 275 of 1996)

The manager of an abattoir may, subject to such conditions as he sees fit, authorize the collection from the abattoir by private transport of the dressed carcass of and the offal from a food animal which has been slaughtered in the abattoir. (L.N. 279 of 1991)
The manager shall not authorize a collection by private transport under subsection (1)—
at any hour that will cause hindrance to the operation of the abattoir; or
if in his opinion the vehicle by which the dressed carcass or offal is to be removed is not of suitable construction and in a clean and satisfactory condition.
Any person who—
removes a dressed carcass or offal by private transport from an abattoir without the authority of the manager under subsection (1); or
having obtained such authority fails to comply with the conditions, if any, to which the authorization is subject,
shall be guilty of an offence and shall be liable on conviction to a fine at level 4 and to imprisonment for 6 months. (L.N. 284 of 1987; L.N. 279 of 1991; L.N. 177 of 1996)
In the event of the manager of an abattoir having required or authorized the collection by private transport of the dressed carcass of and the offal from a food animal under section 33(1), such dressed carcass and offal shall be available for collection from the abattoir by the owner, or by any person who has been approved by the manager as the agent of the owner, during working hours on the day on which such food animal has been slaughtered, unless an alternative arrangement has been made between the owner and the manager as to the time of collection thereof. If the owner or his agent fails to collect such dressed carcass and offal from the abattoir within the time specified by or arranged with the manager in accordance with subsection (1) the manager may cause such dressed carcass and offal to be disposed of as he thinks fit.
No person shall enter, remain in or take a motor vehicle into an abattoir without a valid entry permit for himself, and for the vehicle (if any), issued by the manager.
The person to whom an entry permit has been issued shall, while he enters, remains in or takes a motor vehicle into an abattoir, affix in a prominent position to his outer clothing and the windscreen of the motor vehicle (if any) the appropriate entry permit such that the details shown on the entry permit are clearly visible.
An entry permit issued by the manager shall be subject to such conditions as he thinks fit.
A person who contravenes subsection (1) or (2) commits an offence. (78 of 1999 s. 7)
The manager may order a person without an entry permit for himself to leave the abattoir and remove or cause to be removed from the abattoir the motor vehicle (if any) the person takes in.
The manager may order a person with an entry permit for himself to remove or cause to be removed from the abattoir any vehicle which the person takes in if it is without an entry permit.
If a person fails to comply with an order under subsection (5) or (6), the manager may remove or cause to be removed from the abattoir the person or the motor vehicle. (78 of 1999 s. 7)
The manager may declare any part of an abattoir to be a restricted area and shall indicate such area by means of signs.
No person shall enter or remain in a restricted area without a pass issued by the manager in the form in Schedule 7.
The manager may at any time cancel or suspend a pass issued under subsection (2). (L.N. 307 of 1998; 78 of 1999 s. 7)
Any person who contravenes subsection (2) shall be guilty of an offence. (78 of 1999 s. 7)
If it appears to an authorized officer that a person does not have good cause for being in an abattoir, he may order such person to leave the abattoir forthwith.
Any person who fails to comply with an order under subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine at level 4 and to imprisonment for 6 months. (L.N. 284 of 1987; L.N. 279 of 1991; L.N. 177 of 1996; 78 of 1999 s. 7)
The manager of an abattoir may cause to be erected in the abattoir such signs and notices as are in his opinion necessary for the proper control of traffic in the abattoir.
An authorized officer may give to any person appearing to him to be in charge of a vehicle in an abattoir such directions as are in his opinion necessary for the proper control of the movement or parking of the vehicle in the abattoir.
Any person who, being the driver or person having the charge of a vehicle in an abattoir, fails to comply with—
a sign or notice erected under subsection (1); or
a direction given to him under subsection (2),
shall be guilty of an offence. (78 of 1999 s. 7)
The manager of an abattoir may by order in writing prohibit smoking or the use of any naked flame or light in any part of the abattoir.
A copy of an order under subsection (1) shall be posted in a conspicuous place outside the part of the abattoir to which it relates.
Any person who smokes or uses a naked flame or light in contravention of an order under subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine at level 4 and to imprisonment for 6 months. (L.N. 284 of 1987; L.N. 177 of 1996)
No person shall keep goods or personal effects in an abattoir except in a place approved for the purpose by the manager.
Any person who contravenes subsection (1) shall be guilty of an offence.
The manager may direct any person appearing to him to be the owner of any goods or personal effects kept in the abattoir in contravention of subsection (1) to remove them forthwith from the abattoir or to an approved place therein.
If—
any person fails to comply within 48 hours with a direction under subsection (3); or
the manager is satisfied that the owner of any goods or personal effects stored in contravention of subsection (1) cannot be ascertained or found,
the manager may cause the goods or personal effects to be disposed of in such manner as he thinks fit.
An authorized officer may—
prohibit; or
give directions to any person in an abattoir in respect of,
the use of any supply of water, steam or electricity, or any water, steam, electrical or ventilating equipment in an abattoir.
Any person who uses or interferes with—
any supply of water, steam or electricity; or
any water, steam, electrical or ventilating equipment,
in contravention of a prohibition or direction under subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine at level 4 and to imprisonment for 6 months. (L.N. 284 of 1987; L.N. 279 of 1991; L.N. 177 of 1996; 78 of 1999 s. 7)
Any person who—
obstructs any other person making lawful use of an abattoir or of any facilities or services provided therein; or
without lawful authority interferes with any equipment provided in an abattoir,
shall be guilty of an offence and shall be liable on conviction to a fine at level 4 and to imprisonment for 6 months.
Any person who—
spits, urinates or deposits any refuse in an abattoir, otherwise than in a place provided for the purpose;
puts up or affixes any notice or poster in an abattoir, except with the consent of the manager and in a place provided for the purpose;
without the consent of the manager, brings into or keeps in an abattoir any intoxicating liquor or drug; (L.N. 279 of 1991)
takes part in any process of the trimming, cutting, tying, washing or handling of an offal in an abattoir otherwise than in a place provided for the purpose; or (L.N. 279 of 1991)
behaves in a disorderly manner in an abattoir, (L.N. 33 of 1975)
shall be guilty of an offence.
Any person who, in any form required by, under or for the purposes of this Regulation, makes any statement or furnishes any information which he knows or reasonably ought to know to be false in a material particular shall be guilty of an offence and shall be liable on conviction to a fine at level 4 and to imprisonment for 6 months.
Except as provided in sections 28 and 29, no person shall mark the carcass or the offal of a food animal, whether or not it has been slaughtered in an abattoir, with a mark specified in Schedule 6 or with a mark so closely resembling a mark specified in Schedule 6 as to be likely to mislead. Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine at level 5 and to imprisonment for 6 months. (L.N. 284 of 1987; L.N. 177 of 1996; L.N. 275 of 1996)
Every person who commits an offence under this Regulation for which no other penalty is provided shall be liable on conviction to a fine at level 4 and to imprisonment for 6 months.

Nothing in this Regulation shall be deemed to derogate from or in any way affect the provisions of the Public Health (Animals and Birds) Ordinance (Cap. 139).
Without prejudice to the provisions of any other enactment relating to the prosecution of criminal offences and without prejudice to the powers of the Secretary for Justice in relation to those offences, a prosecution for an offence under this Regulation may be brought in the name of the Director.
