To provide for the incorporation of the Bishop of the Roman Catholic Church in Hong Kong.

This Ordinance may be cited as the Bishop of the Roman Catholic Church in Hong Kong Incorporation Ordinance.

The Bishop of the Roman Catholic Church in Hong Kong, and his successors in the office of Bishop of the Roman Catholic Church in Hong Kong, shall be a corporation sole, hereinafter called the corporation, and shall have the name of “The Catholic Diocese of Hong Kong (天主敎香港敎區)”, and in that name shall have perpetual succession, shall be capable of suing and being sued, and shall have a common seal.

Subject to subsection (3), the corporation shall have the following powers—
to acquire, lease, hold and enjoy any land or buildings on such terms as it thinks fit;
to invest its money—
on deposit at any bank, whether in Hong Kong or elsewhere; or
in the stocks, shares, or securities of any corporation carrying on business either in Hong Kong or elsewhere;
to purchase, hire or acquire any movable property;
to sell, lease or otherwise dispose of, and to charge, any of its property on such terms as it thinks fit;
to develop or turn to account any of its immovable property in such manner and on such terms as it thinks fit;
to borrow money for the corporation’s purposes and to charge all or any of its property.
The powers conferred on the corporation by subsection (1) may be exercised either alone or jointly with one or more other persons.
In respect of land and buildings—
acquired with public money; or
granted by the Government for any special purpose,
prior to the commencement* of this Ordinance, the powers conferred on the corporation by subsection (1)(d), (e) and (f) shall not be exercised except with the consent of the Chief Executive in Council. (Amended 33 of 1999 s. 3)

Nothing in this Ordinance shall affect or be deemed to affect the rights of the Central Authorities or the Government of the Hong Kong Special Administrative Region under the Basic Law and other laws, or the rights of any body politic or corporate or of any other persons except such as are mentioned in this Ordinance and those claiming by, from or under them.
