Tsing Ma Control Area (General) Regulation

In this Regulation, unless the context otherwise requires—
bus (巴士) has the same meaning as in the Road Traffic Ordinance (Cap. 374); (L.N. 104 of 2009) heavy goods vehicle (重型貨車) has the same meaning as in the Road Traffic Ordinance (Cap. 374); (L.N. 104 of 2009) lane (行車綫) means a lane for the passage of traffic within the Area; light signal (交通燈) has the same meaning as in the Road Traffic (Traffic Control) Regulations (Cap. 374 sub. leg. G); medium goods vehicle (中型貨車) has the same meaning as in the Road Traffic Ordinance (Cap. 374); (L.N. 104 of 2009) middle lane (中間行車綫) means any lane between the nearside lane and the right most lane (in relation to the direction of traffic) in any road within the Area; (L.N. 104 of 2009) nearside lane (左邊行車綫) means the left most lane (in relation to the direction of traffic) in any road within the Area; prescribed light signal (訂明交通燈) means a light signal of the size, design, colour and type prescribed in Schedule 1 or under the Road Traffic (Traffic Control) Regulations (Cap. 374 sub. leg. G); prescribed road marking (訂明道路標記) means a road marking of the size, colour and type prescribed in Schedule 2 or under the Road Traffic Ordinance (Cap. 374) or its subsidiary legislation; prescribed traffic sign (訂明交通標誌) means a traffic sign of the size, colour and type prescribed in Schedule 1 or under the Road Traffic Ordinance (Cap. 374) or its subsidiary legislation; road marking (道路標記) has the same meaning as in the Road Traffic Ordinance (Cap. 374); traffic sign (交通標誌) has the same meaning as in the Road Traffic Ordinance (Cap. 374); utility (公用事業設施) means any electric power cable, telephone cable or other cable used in communication, any telecommunications apparatus, any pipe used for the supply of water, gas or oil, or for drainage or sewage, together with any duct for such cable or pipe and any apparatus or works ancillary to such cable, apparatus, pipe or duct; wind susceptible vehicle (受風車輛) means a vehicle with an overall height exceeding 1.6 m, a motor cycle or a motor tricycle.The Commissioner may—
erect or display any prescribed traffic sign or prescribed light signal; or
place any prescribed road marking,
at any place within the Area.
The meaning of a traffic sign or light signal prescribed in Schedule 1 or a road marking prescribed in Schedule 2 shall be in accordance with such sign, signal or marking and the note, if any, relating thereto in Schedule 1 or 2, as may be appropriate.
The Commissioner may—
revoke any traffic sign, light signal or road marking erected, displayed or placed under this Regulation; or
vary or temporarily suspend the operation of such a traffic sign, light signal or road marking by covering it or erecting, displaying or placing another traffic sign, light signal or road marking.
An operator may, for the purpose of discharging his duties and obligations under a management agreement, exercise any power of the Commissioner under subsection (1) or (3) in respect of any prescribed traffic sign, prescribed light signal or prescribed road marking specified by the Commissioner for the time being.
The Commissioner, or an operator with the approval of the Commissioner, may, for the guidance of the people using the Area—
erect or display any advisory traffic sign or light signal; or
place any advisory road marking,
within the Area, with advice and information relating to the use of the Area.
Any traffic sign, light signal or road marking erected, displayed or placed under section 3 must be of such size, colour and type as the Commissioner considers appropriate.
Where a person erects, displays or places a traffic sign, light signal or road marking within the Area, without the prior consent in writing of the Commissioner, the Commissioner may—
order the person who erected, displayed or placed it to remove it; and
if that person does not comply with the order, remove or direct an operator to remove the traffic sign, light signal or road marking.
The Commissioner may vary any figure or the direction of an arrow on or in relation to any prescribed traffic sign, prescribed light signal or prescribed road marking to adapt that traffic sign, light signal or road marking to the particular circumstances of the Area.
An operator may, for the purpose of discharging his duties and obligations under a management agreement, exercise the power of the Commissioner under subsection (1) in respect of any prescribed traffic sign, prescribed light signal or prescribed road marking specified by the Commissioner for the time being.
Where a traffic sign, light signal or road marking erected, displayed or placed for the purposes of this Regulation varies or differs in size, colour or type from the relevant prescribed traffic sign, prescribed light signal or prescribed road marking, the variation or difference shall not prevent the traffic sign, light signal or road marking from being treated as a prescribed traffic sign, prescribed light signal or prescribed road marking if the variation or difference does not materially impair its appearance.
Where the Commissioner or an operator considers that a road diversion, or the total or partial closure of any road is necessary, the Commissioner or the operator, as the case may be, may position across any road within the Area, a barrier or gate of a size, colour and type as the Commissioner considers appropriate.
Where a barrier or gate has been positioned across the road under subsection (1), a person shall not drive a vehicle beyond that barrier or gate.

Any person within the Area shall comply with the prescribed traffic signs, prescribed light signals and prescribed road markings erected, displayed or placed within the Area unless he is exempted from doing so under section 23.
Where the Commissioner or an operator considers that there is or likely to be a risk of danger to the public or of damage to or on any road or structure, the Commissioner or the operator, as the case may be, may at any time and without notice, erect or display within the Area, a traffic sign or light signal of such size, colour and type as he considers appropriate for the purpose of fixing a temporary speed limit for vehicles using that road.
Where a temporary speed limit is fixed in accordance with subsection (1) on any road, a person shall not drive a vehicle on that road at a speed in excess of that speed limit.
The Commissioner or the Director may direct an operator to close either totally or partially any road within the Area to the public whenever a closure appears to be reasonably necessary.
The operator shall comply with any direction under subsection (1) and any subsequent direction to re-open the closed road.
The operator shall not re-open any road closed under subsection (1)—
without the prior consent of; or
unless directed to do so by,
the Commissioner or the Director.
Subject to subsection (5), an operator shall not close, either totally or partially, a road within the Area to the public without the prior permission of the Commissioner or the Director.
An operator may close to the public, either totally or partially, and at any time and for a period not exceeding 3 days—
any road (including a bridge) within the Area for any one or more of the following reasons—
the occurrence of an emergency or accident, including fire, traffic accident, vehicle breakdown or equipment failure;
the safety of persons and vehicles within the Area;
the need for any emergency works to be carried out; and
any bridge within the Area, for all vehicles or wind susceptible vehicles only, where he considers that there is or likely to be danger due to inclement weather.
Where an operator closes either totally or partially any road or bridge under subsection (5)(a) or (b) he shall notify the Commissioner and the Director as soon as practicable after the closure.
Unless complying with a prescribed traffic sign, prescribed light signal or prescribed road marking or with a direction or signal of a police officer or an authorized officer, a person shall not—
in any tunnel—
drive a vehicle at a speed of less than 25 km per hour except where prevented by another vehicle or at places where a speed of less than 25 km per hour is unavoidable;
drive a vehicle with that vehicle’s headlights illuminated at full beam; or
make any U turn with or reverse a vehicle;
within the Area—
stop a vehicle or permit it to be stationary unless he is—
lawfully required to do so;
compelled to do so by reason of accident, breakdown, emergency or the presence of other stationary vehicles;
alight from a vehicle except in the event of an emergency or to summon assistance;
change a tyre or wheel on, or refuel or repair a vehicle;
propel a vehicle by pushing that vehicle, whether manually or by any other means; or
drive a vehicle on any footway unless complying with any prescribed traffic sign, prescribed light signal or prescribed road marking, or complying with the direction or signal of a police officer or an authorized officer; or
enter the Area on foot.
A person shall not drive or cause or permit to be driven, or cause to remain, in a tunnel—
a vehicle which is not carrying sufficient fuel in its fuel tank to enable it to be driven through that tunnel;
a vehicle carrying animals or poultry not properly controlled or confined, or carrying a load which is not sufficiently covered;
a vehicle with a load, or the covering of a load, which is not properly secured so as to prevent any part of the load or that covering from falling off the vehicle or otherwise coming into contact with any part of the tunnel (including any fittings or fixtures); or
a vehicle which will or is likely to come into contact with any part of the tunnel (including any fittings or fixtures).
A person shall not drive or cause or permit to be driven, or cause to remain, on a road within the Area, a vehicle which will or is likely to endanger any person or property or render any part of the Area unsafe.
Subject to subsection (2), a person must not drive or cause or permit to be driven, or cause to remain, in a tunnel— (29 of 2021 s. 51)
a vehicle carrying any Class 1 dangerous goods; (29 of 2021 s. 51)
a vehicle carrying any Class 2 dangerous goods, unless— (29 of 2021 s. 51)
there is a quantity specified in relation to the Class 2 dangerous goods in column 5 of the table in Part 2 of Schedule 2 to the DG(AE)R; and
the Class 2 dangerous goods carried by the vehicle do not exceed that quantity; (29 of 2021 s. 51)
without limiting paragraph (b), a vehicle carrying a pressure receptacle used or to be used for the storage of Class 2 dangerous goods, whether or not the pressure receptacle contains any quantity of Class 2 dangerous goods; (29 of 2021 s. 51)
a vehicle carrying any Class 3 dangerous goods, unless— (29 of 2021 s. 51)
there is a quantity specified in relation to the Class 3 dangerous goods in column 5 of the table in Part 2 or 3 of Schedule 2 to the DG(AE)R; and
the Class 3 dangerous goods carried by the vehicle do not exceed that quantity; (29 of 2021 s. 51)
without limiting paragraph (d), a vehicle—
constructed or adapted for the conveyance of Class 3 dangerous goods; or
carrying a container used or to be used for the storage of Class 3 dangerous goods,
whether or not the vehicle or container contains any quantity of Class 3 dangerous goods; (29 of 2021 s. 51)
a vehicle carrying any Class 3A dangerous goods, unless—
there is a quantity specified in relation to the Class 3A dangerous goods in column 5 of the table in Part 4 of Schedule 2 to the DG(AE)R; and
the Class 3A dangerous goods carried by the vehicle do not exceed that quantity; or (29 of 2021 s. 51)
without limiting paragraph (f), a vehicle—
constructed or adapted for the conveyance of Class 3A dangerous goods; or
carrying a container used or to be used for the storage of Class 3A dangerous goods,
whether or not the vehicle or container contains any quantity of Class 3A dangerous goods. (29 of 2021 s. 51)
Despite subsection (1), nothing in this Regulation prohibits the conveyance in any tunnel—
of fuel which is being carried in the fuel tank of a vehicle for the purpose only of the propulsion of the vehicle; (L.N. 488 of 1997)
in the case of a vehicle carrying in its fuel tank petroleum spirit for the purpose only of its propulsion, by the vehicle of petroleum spirit, up to a maximum of 20 litres in securely closed cans, which is being carried on the vehicle for such purpose; or (L.N. 488 of 1997)
of petroleum spirit which is being carried in a vehicle for the purposes of replenishing refueling facilities for vehicles employed on duty in the Area.
In this section—
Class 1 dangerous goods (第1類危險品) has the meaning given by section 2 of the DG(AE)R; Class 2 dangerous goods (第2類危險品) has the meaning given by section 2 of the DG(AE)R; Class 3 dangerous goods (第3類危險品) has the meaning given by section 2 of the DG(AE)R; Class 3A dangerous goods (第3A類危險品) has the meaning given by section 2 of the DG(AE)R; DG(AE)R (《適用及豁免規例》) means the Dangerous Goods (Application and Exemption) Regulation 2012 (Cap. 295 sub. leg. E); pressure receptacle (壓力氣體容器) has the meaning given by section 92 of the Dangerous Goods (Control) Regulation (Cap. 295 sub. leg. G). (29 of 2021 s. 51)A person must not drive any of the following vehicles in the right most lane or middle lane of the tunnel—
a bus;
a vehicle towing another vehicle;
a vehicle in respect of which a permit is required under section 22.
A person must not drive a medium goods vehicle or a heavy goods vehicle in the right most lane of the tunnel.
Subsection (2) does not apply to a vehicle that is also within the description of subsection (1)(b) or (c).
The Director may, on application made in writing and containing such particulars as he may require for the purposes of this section, issue a road works permit to authorize the applicant to carry out any road works within the Area.
The Director may—
erect, display or place and maintain, or direct an operator or his agent to erect, display or place and maintain traffic signs, light signals, road markings or lanterns of such size, colour and type as he considers appropriate for the purpose of lighting, marking, and guarding road works; and
determine fees (including reasonable administrative charges) (lighting and guarding fees) payable in respect thereof.
A person responsible for any road works under a permit issued under subsection (1) shall pay to the Director or the operator, as may be appropriate, the lighting and guarding fees determined for the time being.
The lighting and guarding fees may be collected by—
the Director, in a manner determined by him, where they are payable to him;
an operator, in a manner determined by him, where they are payable to him.
For the avoidance of doubt it is stated that a person who carries out road works under a permit issued under this section or a person referred to in section 17(2) is not required to obtain an excavation permit under section 10A or 10D, or an emergency excavation permit under section 10C of the Land (Miscellaneous Provisions) Ordinance (Cap. 28) or a permit under Part IV of the Road Traffic (Expressway) Regulations (Cap. 374 sub. leg. Q). (29 of 1998 s. 104; 17 of 2003 s. 16)
Subject to subsection (2), a person who carries out road works on an expressway within the Area—
shall comply, in addition to the conditions specified in the permit issued under section 16, with the conditions specified in Schedule 3 to the Expressway Regulation; and
shall not use, in connection with the road works, a vehicle other than a vehicle which complies with the conditions specified in that Schedule.
A person who is authorized by the Director to carry out road works without a permit referred to in section 16, on an expressway within the Area—
shall comply with the conditions specified in Schedule 4 to the Expressway Regulation; and
shall not use, in connection with the road works, a vehicle other than a vehicle which complies with the conditions specified in that Schedule,
when carrying out the road works.
The Director, the Commissioner or the Commissioner of Police may exempt any person or vehicle referred to in subsection (1) from the conditions specified in Schedule 3 to the Expressway Regulation.
In this section—
expressway (快速公路) has the same meaning as in the Expressway Regulation; Expressway Regulation (快速公路規例) means the Road Traffic (Expressway) Regulations (Cap. 374 sub. leg. Q).Subject to subsection (2), where a road works permit has been issued under section 16, the person responsible for carrying out the road works shall display the road works permit or a copy of that permit in some conspicuous place at, or in the vicinity of, those road works.
Subsection (1) does not apply where the road works are being carried out from, or by means of, a vehicle, but, in such a case, the driver of the vehicle shall have with him the road works permit or a copy of that permit and shall immediately produce it for inspection if so requested by the Commissioner, the Director, an authorized officer or a police officer.

A person shall not, within the Area, drive a vehicle—
the width (including any load and any equipment attached to the vehicle) of which exceeds 2.5 m;
the length (including any load and any equipment attached to the vehicle) of which exceeds 12 m;
the height (including any load and any equipment attached to the vehicle) of which exceeds 4.6 m;
that is drawing a trailer and the combined length of the vehicle and trailer (including drawbar and any load) exceeds 16 m;
that requires a movement permit under regulation 53(1) of the Road Traffic (Registration and Licensing of Vehicles) Regulations (Cap. 374 sub. leg. E); or
that is so loaded that its gross vehicle weight exceeds the permitted maximum gross vehicle weight or if applicable, the permitted maximum gross combined weight, assigned or determined in respect of that vehicle under the Second Schedule to the Road Traffic (Construction and Maintenance of Vehicles) Regulations (Cap. 374 sub. leg. A),
other than in accordance with the conditions of a permit issued by the Commissioner or by an operator, under the terms of a management agreement, for the passage of that vehicle.
A person shall not drive a vehicle on any road within the Area which is closed unless prior permission has been obtained—
from the Commissioner;
from the Director; or
from an operator, under the terms of a management agreement,
as may be appropriate in the circumstances.
A permit issued under subsection (1) is subject to such conditions as the Commissioner may specify.
Without prejudice to the generality of subsection (3), the Commissioner or, under the terms of a management agreement, an operator, may require that a vehicle which is the subject of a permit issued under subsection (1) or a vehicle in respect of which permission has been given under subsection (2), be accompanied by an escort vehicle, provided by the Commissioner or the operator, as the case may be, when passing through the Area.
The driver of a vehicle in respect of which a permit has been issued under this section shall immediately produce the permit for inspection by a police officer or an authorized officer when called upon to do so.
This Regulation does not apply to the following persons to the extent and in the circumstances described in relation to the person— (L.N. 160 of 2021)
sections 7(2), 9, 10(2), 12(a), (b)(i), (ii) and (v) and (c), 14 and 15 do not apply to the driver or owner of a vehicle of the Fire Services Department, an ambulance, a police vehicle, a customs and excise vehicle or a vehicle used for defence purposes (including civil defence purposes) where the vehicle is being used in the course of urgent duties;
sections 7(2), 9, 10(2) and 12(a), (b)(i), (ii) and (v) and (c) do not apply to—
a person engaged in the maintenance, repair, cleaning, clearance, survey, inspection, alteration or improvement of a road within the Area;
a person engaged in the erection, laying, placing, maintenance, testing, alteration, repair or removal of any structure, works or apparatus in, on, under or over any part of a road within the Area;
a person engaged in any activity which is the subject of a permit issued by the Commissioner or the Director;
sections 9 and 10(2) do not apply to—
a person engaged in the avoidance or prevention of an accident or obtaining or giving assistance required as a result of an accident or emergency;
a person engaged in providing the necessary assistance as a result of a vehicle stopping on any road within the Area by reason of a breakdown, other defect or as a result of any other circumstances outside the control of the driver;
sections 7(2), 9, 10(2), 12(a), (b)(i), (ii) and (v) and (c), 14 and 15 do not apply to a person who is complying with any direction given by a police officer or an authorized officer on duty in the Area; (L.N. 160 of 2021)
sections 7(2), 9, 10(2), 12 and 15 do not apply to—
a public officer or an authorized officer on duty in the Area; or
the following persons engaged in road works in the Area—
an agent or subcontractor appointed by the Director; and
maintenance staff, an agent or subcontractor appointed by an operator; (L.N. 160 of 2021)
section 22(1)(a) does not apply to a person who drives a specified bus if—
there is in force a Cap. 374A approval in relation to the width of the bus; and
the approval applies in relation to the use of the Area by the bus and does not contain a term or condition to the effect that the use is restricted; (L.N. 160 of 2021)
section 22(1)(b) does not apply to a person who drives a specified bus if—
there is in force a Cap. 374A approval in relation to the length of the bus; and
the approval applies in relation to the use of the Area by the bus and does not contain a term or condition to the effect that the use is restricted. (L.N. 160 of 2021)
In this section—
Cap. 374A (《第374A章》) means the Road Traffic (Construction and Maintenance of Vehicles) Regulations (Cap. 374 sub. leg. A); Cap. 374A approval (《第374A章》批准) means—(a)an exemption from regulation 6(1) of Cap. 374A granted under regulation 4 of Cap. 374A; or(b)a permit given under regulation 6(2) of Cap. 374A; specified bus (指明巴士) means a bus that is not an articulated vehicle as defined by regulation 2 of Cap. 374A. (L.N. 160 of 2021)A person shall not—
paint or affix any poster, placard, bill, or other matter except with the permission of the Commissioner;
tamper with any installation, structure, building, facility, utility, equipment, appliance, vehicle or other article;
enter or remain in any building or other facility without approval or permission of a public officer who is the subject of a delegation under section 9 of the Ordinance or any other person employed by an operator who is authorized by the operator to give such approval or permission,
within the Area.
Any person who—
contravenes section 7(2), 9, 10(2), 12, 13, 14(1) or 15; (E.R. 3 of 2023)
carries out road works, without a permit under section 16(1), within the Area or is in breach of a condition in a permit issued under that section;
contravenes section 17(1) or 18; (L.N. 38 of 2020)
contravenes section 22(1) or (2), fails to comply with a requirement made under section 22(4) or fails to comply with section 22(5); or
contravenes section 24,
commits an offence and is liable to a fine at level 2 and to imprisonment for 6 months.

In this Part—
commencement date (生效日期) means the date on which Division 23 of Part 3 of the Dangerous Goods (Miscellaneous Amendments) Ordinance 2021 (29 of 2021) comes into operation; transitional period (過渡期) means the period of 24 months beginning on the commencement date.A contravention of section 14(1)(a), (b), (c), (d), (e), (f) or (g) (as the case may be) during the transitional period does not constitute an offence under section 25(a) if the act or omission that constitutes the contravention, had it happened before the commencement date, would not have constituted a contravention of section 14(1)(a), (b), (c), (d) or (e) (as the case may be) in force immediately before the commencement date.
Subsection (2) applies if during the transitional period an act or omission of a person constitutes a failure to comply with the requirement indicated by Figure No. 6 traffic sign (new requirement).
The person does not contravene section 9 in relation to the new requirement and the failure to comply with the new requirement does not constitute an offence under section 25(a) if the act or omission does not constitute a failure to comply with the old requirement.
In this section—
Figure No. 6 traffic sign (第6號圖形交通標誌) means a traffic sign of the type shown in Figure No. 6 prescribed in Schedule 1; old requirement (舊規定) means the requirement indicated by Figure No. 6 traffic sign in accordance with the traffic sign and the note relating to the traffic sign in the pre-amended Schedule 1; pre-amended Schedule 1 (前附表1) means Schedule 1 in force immediately before the commencement date.(L.N. 38 of 2020; 29 of 2021 s. 53)

Dangerous Goods Prohibited
This sign indicates that vehicles carrying dangerous goods of particular classes are prohibited from passing beyond the sign.
It may be used in conjunction with the sign in Figure No. 7.(29 of 2021 s. 53)
This sign when used in conjunction with the sign in Figure No. 6 indicates the class or classes of dangerous goods referred to in that figure.

Keep in Lane
This sign indicates that vehicles must keep in their lanes.

Lane Signal
The signal may in a tunnel area be placed in a vertical or horizontal position above or at the side of a lane for the control of that traffic proceeding along the lane over or at the side of and in relation to which the signals have been placed, provided that when the signal is placed above the lane the green arrow shall point downwards.
The significance of the signal shall be as follows—
when a green arrow is displayed vehicular traffic proceeding in the lane above or at the side of and in relation to which it is displayed may proceed along that lane;
when a steady or intermittent amber light is displayed vehicular traffic proceeding in the lane above or at the side of and in relation to which it is displayed shall proceed along that lane with caution and be prepared to stop, provided that the amber light may be omitted from any signal installation when the signal shall consist of a light capable of showing a red cross and a light capable of showing a green arrow;
when a red cross is displayed vehicular traffic proceeding in the lane above or at the side of and in relation to which it is displayed shall not proceed beneath or beyond or past the red cross.

Parking Place for Motor Cycles
This sign indicates that when used in conjunction with the road marking in Figure No. 2 in Schedule 2, the parking place is for motor cycles only.
