Amusement Rides (Safety) (Operation and Maintenance) Regulation

In this Regulation, unless the context otherwise requires—
chief operator (主操作員), in relation to any duty required to be performed by him under this Regulation, means an operator who has been appointed under section 8(4)(b) to be a chief operator; competent person (主管人員), in relation to any duty required to be performed by him under this Regulation, means a person who—(a)is employed by the owner of an amusement ride as a competent person pursuant to section 8(1); and(b)has been approved under section 5(2); operator (操作員), in relation to any duty required to be performed by him under this Regulation, means a person who is employed by the owner of an amusement ride as an operator pursuant to section 8(1); qualified person (合資格人員), in relation to the carrying out of any examination required to be performed by him under this Regulation, means a person who—(a)not being employed by the owner of an amusement ride, is appointed by the owner to carry out any examination; and(b)has been approved under section 5(3); surveyor (檢測員), in relation to the carrying out of any examination required to be performed by him under this Regulation, means a person who—(a)not being employed by the owner of an amusement ride, is appointed by the owner to carry out any examination; and(b)has been approved under section 5(1).Parts III, IV, V, VI and VII shall not apply to a kiddie ride.
An application for the approval of a person as a surveyor, competent person or qualified person shall be made in the prescribed form to the Director and be accompanied by the prescribed fee.
Where, on application for the approval of a person as a surveyor, the Director is satisfied that—
the person—
is a registered professional engineer, within the meaning of the Engineers Registration Ordinance (Cap. 409), who is qualified as a mechanical, marine, electrical or electronic engineer; and
has not less than 3 years relevant practical experience; or
by reason of the person’s knowledge and relevant practical experience, he is competent to carry out the examinations required by this Regulation to be carried out by a surveyor,
the Director shall approve that person as a surveyor.
Where, on application for the approval of a person as a competent person, the Director is satisfied that—
the person has—
a higher certificate or higher diploma in mechanical, marine, electrical or electronic engineering from the Hong Kong Polytechnic or a technical institute; and
not less than 5 years relevant practical experience; or
by reason of the person’s knowledge and relevant practical experience, he is competent to perform the duties required by this Regulation to be performed by a competent person,
the Director shall approve that person as a competent person.
Where, on application for the approval of a person as a qualified person, the Director is satisfied that—
the person has—
a higher certificate or higher diploma in mechanical, marine, electrical or electronic engineering from the Hong Kong Polytechnic or a technical institute; and
not less than 3 years relevant practical experience; or
by reason of the person’s knowledge and relevant practical experience, he is competent to carry out the examinations required by this Regulation to be carried out by a qualified person,
the Director shall approve that person as a qualified person.
Where the Director approves a person as a surveyor, competent person or qualified person, he shall issue that person with a certificate of approval, which certificate may limit the duties which that person may perform and be subject to such conditions as the Director thinks fit.
A surveyor, competent person or qualified person who has been issued with a limited certificate of approval under subsection (4) shall not perform any duties as a surveyor, competent person or qualified person, as the case may be, for which he has not been approved.
The Director may, on application in the prescribed form made to him by the holder of a limited certificate of approval issued under subsection (4) and on payment of the prescribed fee, amend the certificate by—
altering the duties which the holder may perform as a surveyor, competent person or qualified person, as the case may be;
varying the conditions to which the holder is subject; or
removing all the limitations and conditions.
The Director may, by notice in writing served on the holder of a certificate of approval issued under subsection (4), revoke the certificate if—
the holder has been convicted of an offence under the Ordinance; or
it appears to the Director that the holder has, in performing his duties as a surveyor, competent person or qualified person, as the case may be, been guilty of such negligence or misconduct as to render the holder unfit to be a surveyor, competent person or qualified person, as the case may be.
Where the holder of a certificate of approval issued under subsection (4) is served with a notice under subsection (7) revoking the certificate, he shall—
thereupon cease to be approved as a surveyor, competent person or qualified person, as the case may be; and
surrender that certificate—
to the Director; and
not later than 14 days after the service of that notice.
The owner of an amusement ride shall—
in the case of an existing amusement ride, not later than 3 months after the appointed day;
in any other case, before approval is given under section 10 of the Ordinance to the commencement of operation of the ride,
supply to the Director—
an emergency manual describing the responsibilities of and the detailed emergency actions to be taken by the owner, competent persons, chief operators and operators and the emergency means of communication, equipment and instructions for the safe rescue and evacuation of personnel and the protection of property against damage;
an operation manual prepared by the designer or manufacturer of the ride describing the function and operation of the components of the ride and instructions for the safe usage of the ride; and
a maintenance manual prepared by the designer or manufacturer of the ride describing the recommended maintenance procedures for the ride, including types of lubricants required and the frequency of application, definitions and measurements to determine excessive wear, the recommended frequency of servicing of specific components and the periodic inspections to be carried out.
Where the designer or manufacturer of an amusement ride amends the operation manual or maintenance manual prepared by him, the owner of the ride shall notify the Director of such amendment as soon as reasonably practicable after he receives the amendment from the designer or manufacturer.
The competent person in respect of an amusement ride shall keep and maintain an operational log book in the prescribed form, which shall be made up daily, and which shall contain the following information—
the date;
the names and duties of those operating the ride;
the operating hours of the ride;
confirmation of compliance with—
daily inspections as recommended by the designer or manufacturer of the ride and any other appropriate manuals; and
the provisions of section 10;
details of any accident, malfunction or abnormal occurrence of the ride;
details of any emergency or rescue operation or practice of a rescue operation; and
any other information or occurrences that may be required by the Director.
The competent person in respect of an amusement ride shall also keep and maintain a maintenance log book in the prescribed form which shall—
show a record of periodic inspection and the execution of any maintenance work carried out; and
state the components serviced, the condition of such components and the replacement of such components.
The competent person in respect of an amusement ride shall permit the Director to inspect and copy any log book kept by the competent person under subsection (1) or (2), and the competent person shall afford facilities for such inspection or copying as may be reasonably required by the Director.
The owner of an amusement ride shall not operate the ride—
in the case of an existing amusement ride, on or after the expiration of 3 months immediately following the appointed day;
in any other case, at any time,
unless he has at all times in his employ—
a competent person in respect of the ride; and
such number of operators, to perform such duties, as have been approved by the Director.
The Director may, if in his opinion the safe operation of an amusement ride so requires, vary his approval given under subsection (1)(ii) either as regards the number of operators to be employed on the ride or as regards their duties.
For the purpose of subsection (1), the owner of an amusement ride shall, as soon as is reasonably practicable, submit to the Director a notice in writing giving—
the name of the competent person in respect of the ride; and
the proposed number of operators to be employed in the operation of the ride and details of the proposed duties and hours of work of each operator.
When an amusement ride is in operation, the competent person in respect of the ride shall—
ensure that there is on duty such number of operators as the Director has approved under subsection (1)(ii); and
appoint 1 of those operators to be a chief operator (or, if the Director has approved only 1 operator under subsection (1)(ii), that operator) and ensure that the operator so appointed is informed that he—
has been so appointed; and
is required to perform the duties of a chief operator under this Regulation.
The owner of an amusement ride shall not employ 2 or more competent persons unless—
without prejudice to the generality of section 5(5), he specifies, by notice in writing, the duties to be performed under this Regulation by each competent person; and
no duty so specified in the case of one competent person is the same as a duty so specified in the case of another competent person.
The owner of an amusement ride may, by notice in writing, vary a notice made by him pursuant to subsection (5)(a) if, but only if, he does not thereby contravene subsection (5)(b).
The owner of an amusement ride shall submit to the Director a copy of each notice made by him pursuant to subsection (5)(a) or (6)—
in the case of a notice made pursuant to subsection (5)(a), at the same time as the notice made by him pursuant to subsection (3)(a) is submitted to the Director in respect of the competent person to which the notice made pursuant to subsection (5)(a) relates;
in the case of a notice made pursuant to subsection (6), not later than 14 days after the notice has been made.
For the avoidance of doubt, it is hereby declared that the appointment of an operator as a chief operator shall be without prejudice to any duty required to be performed by him under this Regulation in his capacity as an operator.
The chief operator in respect of an amusement ride shall—
unless otherwise approved by the Director, be subject to the supervision of the competent person in respect of the ride; and
while on duty, be responsible for—
ensuring that all other operators perform their duties satisfactorily;
the safe operation of the ride; and
discharging such other duties as may be imposed upon him under this Regulation.
The duties of operators shall be such as have been approved by the Director under section 8(1)(ii).
An operator on duty shall not be under the influence of alcohol or drugs.
Every day before the commencement of operation of an amusement ride for use by members of the public, the chief operator on duty shall ensure that—
a thorough examination of such indications, controls and safety devices as may be required by the Director has been carried out; and
the ride is in safe working order.
The owner of an amusement ride shall forthwith report to the Director—
the death of any person occurring in connection with the ride;
an injury to any person occurring in connection with the ride that requires hospitalization or treatment by medical professionals;
the failure of any ride (other than mains power supply failure), including—
structure, drive system, control and safety devices; and
any part of the ride where such failure may prejudice the safe operation of the ride;
any rescue operation;
any fire;
any ground settlement or landslide; or
any other occurrences as may be required by the Director.
Subsection (1) shall not derogate from a provision in any other enactment requiring the happening of any occurrence specified in that subsection to be reported to any person.
Where an amusement ride has been involved in an occurrence specified in subsection (1), the Director may—
seize any part of the amusement ride; and
detain that part for so long as is reasonably necessary to examine it.
The chief operator on duty when an amusement ride is in operation shall ensure that there is not carried on the ride any goods likely to cause inconvenience or annoyance to any passenger on the ride or prejudice the safe operation of the ride.
The chief operator on duty when an amusement ride is in operation shall ensure that there is not carried on the ride—
any person whom he believes or is given reasonable cause to believe is under the influence of alcohol or drugs;
any person whom he believes or is given reasonable cause to believe is suffering from a contagious disease;
any person whom he believes or is given reasonable cause to believe may prejudice the safety of the ride;
any person suffering from physical or mental handicap whom he believes or is given reasonable cause to believe would be likely to prejudice the safety of the ride, unless arrangements have been made, with the approval of the Director, for the carriage of such person; or
any person who is considered unsuitable in accordance with notices posted pursuant to section 20 at the entrance to the ride.
The owner of an amusement ride shall ensure that adequate lighting is provided at all times for the safe operation and maintenance of the ride.
Where an amusement ride is exposed to the weather, or partly exposed to the weather, the chief operator on duty shall, upon the hoisting at the Hong Kong Observatory of the No. 3 visual storm warning, cause the operation of the amusement ride to be stopped and, after all passengers being carried on the ride have safely alighted, secure the ride in a safe position. Where the weather conditions are such as to prejudice the safe operation of an amusement ride, the chief operator on duty shall stop the operation of the ride.
The owner of an amusement ride shall ensure that arrangements are made at the ride and the areas associated with it for the marshalling and control of persons using or intending to use the ride so as to provide for safe and orderly traffic, embarkation and disembarkation.
The competent person in respect of an amusement ride shall keep and maintain a written schedule of the systematic maintenance of all parts of the ride, which schedule shall include intervals between the inspection, lubrication, adjustment, protective coating and any other works as recommended by the designer or manufacturer of the ride or the Director.
The competent person in respect of an amusement ride shall permit the Director to inspect and copy the maintenance schedule kept by the competent person under subsection (1), and the competent person shall afford facilities for such inspection or copying as may be reasonably required by the Director.
The competent person in respect of an amusement ride shall ensure that the ride is maintained regularly in accordance with the maintenance schedule kept by him under section 16.
The owner of an amusement ride shall ensure that the ride is examined by a surveyor not less than once every 12 months, the examination to include any structure, electrical, mechanical and safety equipment that may be necessary to ascertain the integrity and safe operation of the ride.
Notwithstanding subsection (1), the Director may require the examination referred to in that subsection to be carried out at any time if, in his opinion, the condition of the amusement ride or any part of the ride is such as to require examination.
The owner of an amusement ride shall ensure that a report of every examination required under this section, prepared by the surveyor making the examination, is sent to the Director not later than 30 days after such examination is completed.
The Director may require the owner of an amusement ride to provide a communications system for the ride, for which purpose the Director may—
specify the type of communications system;
require the owner to take steps to ensure that announcements on that system are in the English language in addition to the Chinese language.
Where an amusement ride is provided with a communications system, the chief operator on duty when the ride is in operation shall not operate the ride unless the communications system is in good working order.
In this section—
communications system (通訊系統) includes a system of intercommunication by radio or telephone, a public-address system and portable loud hailers; good working order (良好操作性能), in relation to a communications system, means the communications system provides safe and effective communication at all times.The owner of an amusement ride shall—
in the case of an existing amusement ride, not later than 1 month after the appointed day;
in any other case, before approval is given under section 10 of the Ordinance to the commencement of operation of the ride,
display, and thereafter keep displayed, notices in the English and Chinese languages—
containing, in respect of the ride, the matters specified in subsection (2); and
that may be readily seen and read by a member of the public being in the vicinity of the ride but, in any case, before he uses the ride.
A notice displayed in accordance with subsection (1) in respect of an amusement ride shall—
warn of any structural, electrical, mechanical or physical danger of the ride;
state the maximum number of passengers and weight permitted to be carried on the ride;
prohibit the carriage of goods as specified in section 12;
prohibit the carriage of persons as specified in section 13;
state the requirement for wearing safety equipment when specified;
state the minimum height of a passenger permitted to be carried on the ride;
state the requirement of parents or guardians attending children; and
contain such other matters that may be required by the Director or the designer or manufacturer of the ride.
The owner of an amusement ride shall not operate the ride—
in the case of an existing amusement ride, on or after the expiration of 3 months immediately following the appointed day;
in any other case, at any time,
unless the equipment provided for and the method of the rescue of passengers have been approved by the Director.
The owner of an amusement ride shall ensure that the equipment provided for the rescue of passengers is regularly examined and kept in a safe state of repair.
The owner of an amusement ride shall ensure that, at all times when the ride is in operation, there is on duty a sufficient number of persons trained in the rescue of passengers.
The competent person in respect of an amusement ride shall carry out practice rescue operations on the ride at such intervals as may be required by the Director.
The competent person in respect of an amusement ride shall ensure that the equipment provided for the rescue of passengers is located at strategic points and that the equipment is sufficiently protected from deterioration by the action of weather, loss by stealing or damage.
Subject to this section, the competent person in respect of an amusement ride shall prepare and issue to each operator (including each chief operator) instructions in writing on the action to be taken by operators—
where there is such stoppage of the ride as may be specified in the instructions;
in the event of the malfunction of a safety device;
in the event of a rescue of passengers;
on the occasion of any fire or accident; and
in the safe-keeping of operating keys,
together with such other instructions that may be required by the Director to improve the safe operation of the ride.
Any instructions prepared by the competent person under subsection (1) shall be approved by the Director before they are issued.
For the purpose of subsection (2), the competent person in respect of an amusement ride shall—
in the case of an existing amusement ride, not later than 4 months after the appointed day;
in any other case, before approval is given under section 10 of the Ordinance to the commencement of operation of the ride,
submit to the Director any instructions prepared by the competent person under subsection (1).
The competent person in respect of an amusement ride shall ensure that—
all trees and vegetation growing adjacent to the ride are trimmed and maintained so as not to endanger the safe operation of the ride; and
rocks, stones and earth and any other matter do not accumulate beneath the ride in such quantities as to affect or endanger the safe operation of the ride.
The owner of an amusement ride shall—
in the case of an existing amusement ride, not later than 3 months after the appointed day;
in any other case, before approval is given under section 10 of the Ordinance to the commencement of operation of the ride,
provide, and thereafter continue to provide, first aid facilities and persons trained in first aid for the operation of the ride.
For the purpose of subsection (1), the owner of an amusement ride shall at all times ensure that—
all first-aiders are fully trained, and regularly retrained, if required, by a recognized first aid training organization;
all first aid boxes and equipment are maintained in a serviceable and sanitary condition;
all materials in a first aid box are those designated in, and are of a grade not lower than the standards specified by, the British Pharmaceutical Code or by any supplement to it;
nothing except appliances and requisites for first aid are kept in a first aid box;
a first aid record book, showing the date, description, quantity and reason of the items used and by whom the items are applied, is maintained and kept in a safe place; and
each first aid box is clearly and legibly marked “FIRST AID 急救” in both the English and Chinese languages.
The owner of an amusement ride shall ensure that protection against injury of all persons employed in the operation of the ride is provided by—
the issue of safety equipment to be used when working in a situation where an employee may be subject to risks; and
adequate training as may be required by the Director subject to any modification of the ride or amendment of the operation and maintenance manuals and procedures.
Every day before the commencement of operation of a kiddie ride for use by members of the public, the owner of the ride shall inspect it or cause it to be inspected to ensure that it is in safe working order.
The owner of a kiddie ride shall keep and maintain, or cause to be kept and maintained, a log book recording every inspection of the ride made pursuant to subsection (1).
The owner of a kiddie ride shall permit the Director to inspect and copy any log book kept by the owner under subsection (2), and the owner shall afford facilities for such inspection or copying as may be reasonably required by the Director.
The owner of a kiddie ride shall forthwith report to the Director—
the death of any person occurring in connection with the ride;
an injury to any person occurring in connection with the ride that requires hospitalization or treatment by medical professionals.
Subsection (1) shall not derogate from a provision in any other enactment requiring the happening of any occurrence specified in that subsection to be reported to any person.
Where a kiddie ride has been involved in an occurrence specified in subsection (1), the Director may—
seize any part of the kiddie ride; and
detain that part for so long as is reasonably necessary to examine it.
The owner of a kiddie ride shall ensure that the ride is examined by a surveyor or qualified person not less than once every 6 months to ascertain the integrity and safe operation of the ride.
The owner of a kiddie ride shall—
ensure that a report of every examination required under this section is prepared by the surveyor or qualified person making the examination; and
permit the Director to inspect and copy such report and afford facilities for such inspection or copying as may be reasonably required by the Director.
The owner of a kiddie ride shall—
in the case of a kiddie ride which is an existing amusement ride, not later than 1 month after the appointed day;
in any other case, before approval is given under section 10 of the Ordinance to the commencement of operation of the ride,
display, and thereafter keep displayed, a notice in the English and Chinese languages—
stating the maximum number of passengers and weight permitted to be carried on the ride; and
that may be readily seen and read by a member of the public being in the vicinity of the ride but, in any case, before he uses the ride.
Any—
surveyor, competent person or qualified person who contravenes section 5(5);
competent person in respect of an amusement ride who—
contravenes section 7(1), (2) or (3), 8(4), 16(1) or (2), 17, 22, 23(1) or (3) or 24; or
fails, without reasonable excuse, to comply with a requirement of the Director under section 7(3), 16(2) or 21(4),
commits an offence and is liable on conviction to the penalty set out in columns 2, 3 and 4 of Part I of the Schedule opposite the reference to that section in column 1 of Part I of the Schedule.
Any—
operator who contravenes section 9(3);
chief operator who—
contravenes section 10(b), 12, 13, 14(2) or (3) or 19(2); or
fails, without reasonable excuse, to comply with a requirement of the Director under section 10(a),
commits an offence and is liable on conviction to the penalty set out in columns 2, 3 and 4 of Part II of the Schedule opposite the reference to that section in column 1 of Part II of the Schedule.
Any owner of an amusement ride who—
contravenes section 6(1) or (2), 8(1), (3), (5), (6) or (7), 11(1), 14(1), 15, 18(1) or (3), 20(1), 21(1), (2) or (3), 25(1) or (2) or 26(a); or
fails, without reasonable excuse, to comply with a requirement of the Director under section 18(2), 19(1) or 26(b),
commits an offence and is liable on conviction to the penalty set out in columns 2, 3 and 4 of Part III of the Schedule opposite the reference to that section in column 1 of Part III of the Schedule.
Any owner of a kiddie ride who—
contravenes section 27(1), (2) or (3), 28(1), 29(1) or (2)(a) or (b) or 30; or
fails, without reasonable excuse, to comply with a requirement of the Director under section 27(3) or 29(2)(b),
commits an offence and is liable on conviction to a fine at level 2 and to imprisonment for 6 months. (E.R. 1 of 2022)
Any surveyor, competent person, qualified person or chief operator who—
delivers to—
the Director; or
the owner of an amusement ride,
any report; or
makes any entry in a record,
which is to his knowledge false in a material particular or which he does not believe to be true commits an offence and is liable on conviction to a fine at level 3 and to imprisonment for 6 months. (E.R. 1 of 2022)
Where it is proved to the satisfaction of a magistrate or court that an offence referred to in subsection (1) (except any such offence which relates to paragraph (a)(ii) of that subsection) has been committed by any surveyor, competent person, qualified person or chief operator, the owner of the amusement ride who appointed the surveyor or qualified person, or employed the competent person or chief operator, as the case may be, shall also be liable for such offence and to the penalty provided for the offence unless he satisfies the magistrate or court that—
the offence was committed without his knowledge or consent; and
he had exercised all due diligence to prevent the commission of the offence as the magistrate or court considers reasonable in the circumstances.
The owner of an amusement ride shall cause every obligation imposed upon—
a surveyor, competent person or qualified person by or under each provision of this Regulation referred to in section 31; and
an operator or chief operator by or under each provision of this Regulation referred to in section 32,
to be complied with.
Subject to subsection (3), any owner of an amusement ride who contravenes subsection (1) commits an offence (whether or not any other person is also convicted of the offence) and is liable on conviction—
where the contravention relates to any provision of this Regulation referred to in section 31, to the penalty set out in columns 2, 3 and 4 of Part IV of the Schedule opposite the reference to that provision in column 1 of Part IV of the Schedule; and
where the contravention relates to any provision of this Regulation referred to in section 32, to the penalty set out in columns 2, 3 and 4 of Part V of the Schedule opposite the reference to that provision in column 1 of Part V of the Schedule.
The owner of an amusement ride shall not be convicted of an offence under subsection (2) if he satisfies a magistrate or court that—
the non-compliance occurred without his knowledge or consent; and
he had exercised all due diligence to prevent the non-compliance as the magistrate or court considers reasonable in the circumstances.
Where the Director requires that anything be done under any of the provisions referred to in section 31(b)(ii), 32(b)(ii) or 33(1)(b) or (2)(b), he shall make the requirement by notice in writing served on the person to whom the requirement relates, and shall in the notice specify a period within which the requirement is to be complied with.
No person shall be held to have failed to comply with any requirement referred to in subsection (1) until the expiration of the period specified in the requirement or such further period as the Director may allow.
A person who contravenes section 5(8)(b) commits an offence and is liable on conviction to a fine at level 1.
