Land Drainage (Consent and Approval) Regulation

In this Regulation, unless the context otherwise requires—
applicant (申請人) means a person seeking the consent or consent and approval, as the case may be, of the Drainage Authority under section 26 or 27 of the Ordinance.An application for consent or consent and approval, as the case may be, of the Drainage Authority under section 26 or 27 of the Ordinance shall be submitted to the Drainage Authority in writing and in duplicate and shall contain the following information—
the full name, address and telephone number of the applicant;
the full name, address and telephone number of the applicant’s authorized representative, if any;
the address of the applicant and his authorized representative, if any, for the service of documents, if different from that given in paragraph (a) or (b);
the location of the premises or place to which the application relates.
An application for consent or consent and approval shall be accompanied by—
2 copies of an explanatory guide to the submission;
2 copies of each of the following plans—
a key plan showing the location of the proposed work to which the application relates and the main watercourse affected thereby drawn to a scale of not less than 1 : 2 500;
a layout plan of the proposed work to which the application relates drawn to a scale of not less than 1 : 100;
elevations of the proposed work to which the application relates drawn to a scale of not less than 1 : 200;
longitudinal sections of the proposed work to which the application relates, both vertical and horizontal, drawn to a scale of not less than 1 : 200; and
cross sections of the proposed work to which the application relates drawn to a scale of not less than 1 : 200;
2 copies of a statement which sets out—
the specifications and design calculations of the proposed work;
the sequence of the proposed work and methods to be employed; and
the proposed mitigation measures, if any, to be taken for maintaining the flow of water in the main watercourse;
2 copies of a report on the assessment of the impact of the proposed work on the flow of the water in the main watercourse with supporting hydrological and hydraulic analyses and calculations which analyses and calculations shall be paginated and prefaced by a comprehensive index; and
2 copies of any supporting documentation referred to in the report mentioned in paragraph (d).
The Drainage Authority may in writing require, within such time as he may specify, the applicant or his authorized representative, if any, to supply in duplicate such further plans, details, specifications and other information as the Drainage Authority may consider necessary to enable him to give proper consideration to the application.
Every plan submitted shall be drawn or reproduced in a clear and intelligible manner on suitable and durable material with clear differentiation between existing work and proposed work.
The application and all plans, explanatory guide, reports, analyses, calculations, specifications, details, supporting documentation and other information submitted to the Drainage Authority shall be signed by the applicant or his authorized representative.
The consent of the Drainage Authority to an application under section 26 or 27 of the Ordinance shall specify any condition subject to which the consent is given and shall be given by serving a written notice of consent on the applicant or his authorized representative.
The consent of the Drainage Authority to an application under section 27 of the Ordinance and his approval to plans submitted in support of such application shall specify any condition subject to which the consent and approval is given and shall be signified by—
serving a written notice of consent with a list of the approved plans on the applicant or his authorized representative, if any;
marking, signing and dating plans approved as “approved plans”; and
returning to the applicant or his authorized representative a copy of each approved plan together with one copy of the calculations and other supporting documents relating thereto.
