Merchant Shipping (Registration) (Fees and Charges) Regulations

These regulations may be cited as the Merchant Shipping (Registration) (Fees and Charges) Regulations.

In these regulations, unless the context otherwise requires—
office hours (辦公時間) means the hours between 8:30 a.m. and 5:45 p.m. on Monday to Friday, excluding general holidays; (L.N. 176 of 2024) surveyor (驗船師) means a Government surveyor; tons (噸) means, unless otherwise specified, gross registered tons and in the case of a ship having alternative gross tonnages means the larger of those tonnages.There shall be payable for the purpose or service mentioned in column 2 of Part 1 of the Schedule the fees specified in column 3 of that Part.
There shall be payable for the purpose or service relating to the tonnage measurement or marking of ships mentioned in column 2 of Part 2 of the Schedule the fees specified in column 3 of that Part.
There is payable in respect of a registered ship, in addition to any fees payable in respect of the ship under regulation 3, the annual tonnage charge as provided under subregulation (2), (2A) or (2C). (L.N. 200 of 2005)
Subject to subregulation (2A), the annual tonnage charge specified in Part 3 of the Schedule is payable in respect of each year of registration of the ship commencing on the date of registration and on each anniversary of that date thereafter. (L.N. 200 of 2005)
Subject to subregulations (2B) and (2C), if—
the ship is a registered ship for 2 consecutive years immediately before an anniversary of the date of registration;
the ship has not been detained at any time during those 2 years; and
the specified annual tonnage charge is payable in respect of the year of registration of the ship immediately before the anniversary,
the specified annual tonnage charge, as reduced by half, is payable in respect of the year of registration of the ship commencing on the anniversary. (L.N. 200 of 2005)
Subregulation (2A) does not apply if—
the ship is a registered ship before 1 February 2006; and
the anniversary is the first or second anniversary of the date of registration after 1 February 2006. (L.N. 200 of 2005)
If—
a ship is a registered ship before 1 February 2006; and
the ship has not been detained at any time during the period that begins on 1 February 2006 and expires at the end of the date immediately before the second anniversary of the date of registration after 1 February 2006,
the specified annual tonnage charge, as reduced by an amount equal to such percentage of the charge as calculated in accordance with subregulation (2D), is payable in respect of the year of registration commencing on that second anniversary. (L.N. 200 of 2005)
The percentage is calculated by using the following formula, with the result rounded up to the nearest percentage—

where D represents the number of days within the period that begins on 1 February 2006 and expires at the end of the date immediately before the first anniversary of the date of registration after 1 February 2006. (L.N. 200 of 2005)
For the purposes of subregulations (2A)(b) and (2C)(b), if the International Maritime Organization is informed, pursuant to paragraph 5.2.1 of International Maritime Organization Assembly Resolution A.787(19), of any remedial action taken in respect of the detention of a ship that takes place at a particular time, the ship is detained at that particular time. There is payable in respect of a provisionally registered ship, in addition to any fees payable in respect of the ship under regulation 3, 1/12 of the specified annual tonnage charge in respect of a registered ship. (L.N. 200 of 2005)
The tonnage charge payable under subregulation (3) is payable in respect of each period of 1 month of provisional registration, commencing on the date of provisional registration. (L.N. 200 of 2005)
Subject to regulation 4A, the annual tonnage charge in respect of a ship is not refundable unless it has been improperly collected.
In this regulation—
specified annual tonnage charge (指明噸位年費) means the annual tonnage charge specified in item 1 of Part 3 of the Schedule. (L.N. 200 of 2005)The Registrar may, on an application made in accordance with subregulation (4), refund the following fees and charges paid in respect of an eligible ship (subject ship)—
if the subject ship is provisionally registered after the application is made—
the fees specified in items 2 and 3 of Part 1 of the Schedule; and
the tonnage charge under regulation 4(3) and the annual tonnage charge specified in item 3 of Part 3 of the Schedule; or
in any other case—
the fee specified in item 1 of Part 1 of the Schedule; and
the annual tonnage charge specified in item 1 of Part 3 of the Schedule for the first year of registration of the subject ship.
However, the Registrar must not refund any fees or charges in respect of the subject ship unless all the conditions specified in subregulation (5) are met.
Also, the Registrar must not refund any fees or charges in respect of the subject ship if any refund has been made in respect of the subject ship under this regulation.
An application under subregulation (1) must—
specify the subject ship and at least one other eligible ship (specified ship) for the purpose of the application;
be made before the earliest date of registration of those ships (first registration date);
be made by a person who is—
the owner of at least one of those ships;
engaged in the business of managing at least one of those ships; or
acting as an agent for at least one of those ships;
contain a declaration that the owner of each of those ships has consented to the making of the application; and
be made to the Registrar in a form specified by the Registrar.
The conditions specified for subregulation (2) are that—
the subject ship is registered or provisionally registered at any time during the period of 24 months beginning on the first registration date (specified period), and the post-delivery period of the ship is not more than 10 years;
the subject ship has, since the date on which it is registered, remained registered for a period of not less than 12 consecutive months;
the specified ship (or at least one specified ship) is registered or provisionally registered at any time during the specified period, and the post-delivery period of the ship is not more than 10 years; and
the accumulated gross tonnage of the subject ship and all or any of the specified ships that meet the condition under paragraph (c) is not less than 50 000 tons.
A refund under subregulation (1) in respect of a subject ship is to be made to the owner of the subject ship at the time of refund.
However, if the registration of the subject ship is closed under Part VII of the Ordinance after the conditions specified in subregulation (5) are met, the refund is to be made to the owner of the subject ship immediately before the closure.
In this regulation—
date of registration (註冊日期), in relation to a ship specified in an application under subregulation (1), means— (a)if the ship is provisionally registered after the application is made—the date on which the ship is provisionally registered; (b)in any other case—the date on which the ship is registered; eligible ship (合資格船舶) means a ship that is not registered or provisionally registered at any time during the period— (a)beginning on the date on which the Merchant Shipping (Registration) (Fees and Charges) (Amendment) Regulation 2024 comes into operation ; and (b)ending immediately before the date of registration of the ship; post-delivery period (交付後期間), in relation to a ship specified in an application under subregulation (1), means the period beginning on the date of delivery of the ship and ending on the date of registration of the ship after the application is made.Where the issue of any certificate or clearance is dependent upon the carrying out of any survey or inspection within Hong Kong during office hours any fees prescribed by these regulations shall include the services of a surveyor together with any travelling or other expenses involved.
Where the issue of any certificate or clearance is dependent upon any survey or inspection to be undertaken outside Hong Kong by a surveyor sent from Hong Kong for that purpose, there shall be payable, in addition to the fee specified in the Schedule, the travelling and subsistence expenses of the surveyor in such reasonable sums as the Director shall determine.
Where in connection with any service specified in the Schedule or the issue of a certificate specified in the Schedule it is, in the opinion of the Director, necessary to incur expense to transmit information, plans, calculations or other documents to places outside Hong Kong by post, telegram, telex, facsimile or similar means there shall be payable in addition to the fee specified in the Schedule the expense involved.
Subject to subregulation (2), where the issue of any certificate or clearance is dependent upon any survey or inspection or where any other service is required to be undertaken by an officer of the Marine Department outside office hours, either at the registry of shipping or at any other place in Hong Kong, there is payable, in addition to the appropriate fee specified in these regulations and the Schedule, if any, a fee in respect of each officer based upon the following scale— (L.N. 176 of 2024)

Where an applicant gives not less than 3 days’ notice of a requirement for any survey, or inspection or other service to the Director, but notwithstanding such notice the Director causes the survey, or inspection or other service to be undertaken outside office hours, no additional fee specified in subregulation (1) is payable unless the applicant has requested that the service be undertaken outside office hours.
For any service other than a service for which a fee is specified in the Schedule—
where an officer of the Marine Department is required to visit a ship or site, the fee payable for each such visit during office hours shall be $3,270 for the first hour or part hour and $1,115 for each subsequent hour or part hour during which the visit continues; and (L.N. 250 of 1992)
the fee payable for such service in any other case during office hours shall be $1,115 for each hour or part hour during which the service continues. (L.N. 250 of 1992)
Where, on the application of the owner, demise charterer or agent of a ship, work on any service in respect of that ship is undertaken by any officer of the Marine Department and, in consequence of any act of the owner, demise charterer or agent, such work is abandoned before the completion thereof, there shall be payable such reasonable sum as the Director may agree with the applicant, having regard to the nature and extent of the work involved.
Where for any purpose any officer of the Marine Department is required to issue any certificate of survey, permit, approval, or document of authority, consequent upon or pertaining to the carrying out of any service specified in Part 2 of the Schedule except where the issue thereof is declared in that Part to be included in the service in question or where a fee for the issue thereof is specified in that Part, there shall be payable a fee of $565. Subject to subregulation (3), where for any purpose any officer of the Marine Department is required to issue any copy of, or to make any alteration in, any certificate of survey, permit, approval, or document of authority, in respect of which the original thereof was issued consequent upon or pertaining to the carrying out of any service specified in Part 2 of the Schedule, whether such copy is required to be issued or such alteration made at the time of the issue of the original or not, there shall be payable—
where no fee for the issue of the original is specified in Part 2 of the Schedule or the issue of the original is declared in that Part to be included in the service, a fee of $565 for each copy or alteration; and (L.N. 250 of 1992; L.N. 336 of 1993; L.N. 337 of 1994; L.N. 274 of 1995)
a fee equal to the amount of the fee specified in Part 2 of the Schedule in any case in which a fee is specified therein for the issue of the original.
No fee shall be payable for the issue of the duplicate of any certificate of survey, permit, approval, or document of authority, in any case in which it is declared in Part 2 of the Schedule that such certificate, permit, approval or document of authority, shall be issued in duplicate.
Where for any purpose any officer of the Marine Department is required to issue any copy of, or make any alteration in, any licence, permit, certificate or document of authority, issued in respect of or pertaining to any service specified in the Schedule, other than in Part 2 thereof, no fee shall be payable for the issue of such copy, or the making of such alteration, unless a fee therefor is so specified in which case such fee shall be payable.
Where the Director consents at the request of any applicant to supply a copy of, or to make any alteration to, any licence, permit, certificate, document or plan referred to in these regulations, there shall be payable, in addition to the fees prescribed for such services therein, a handling charge of such reasonable sum in respect of such service as the Director may agree with the applicant therefor, having regard to the nature and extent of the work involved.
Where an officer of the Marine Department is required to attend, in his capacity as a Government official, any legal proceedings or inquiry in relation to any matter arising out of or in connection with the registration of ships or any other matter arising under the Ordinance, there shall be payable in respect thereof—
where the attendance is in Hong Kong during office hours, a fee of $1,115 for each hour or part hour of attendance; and (L.N. 250 of 1992; L.N. 336 of 1993; L.N. 337 of 1994; L.N. 274 of 1995)
where the attendance is outside Hong Kong, the fee specified in paragraph (a) together with the travelling and subsistence expenses of the officer in such reasonable sums as the Director shall determine.
Where the Director consents to survey, tender advice or examine plans in respect of the structure, machinery or equipment of a ship in so far as such structure, machinery or equipment is to comply with statutory requirements or with any other requirements and no fee for such survey, advice or examination is prescribed, there shall be payable such reasonable sum in respect of such survey, advice or examination as the Director may agree with the applicant therefor, having regard to the nature and extent of the work involved.
No fee shall be payable in respect of any copy of any certificate referred to in these regulations which is supplied at the request of a Government department, or the representative of a government other than the Government of the Hong Kong Special Administrative Region when the copy of a certificate is required for official purposes.
No fee specified in the Schedule shall be payable in respect of any service referred to in these regulations which is performed at the request of any Government department or public body or the representative of any government other than the Government of the Hong Kong Special Administrative Region, but the Director may make such charge in respect of the service rendered as he may consider appropriate.
Subject to subregulation (2), every fee or charge shall be paid by the owner or demise charterer of the ship concerned at the Marine Department in advance of the service, purpose or period, as the case may be, in respect of which the fee or charge is payable.
The Director may in his discretion in any particular case or class of cases permit any fee or charge to be paid, in whole or in part, in arrear, and subject to such conditions as to security or time for payment as he may think fit.
