Government Flying Service (General) Regulation

In this Regulation, unless the context otherwise requires—
auxiliary section (輔助隊員組) means the auxiliary section of the Service; Service (服務隊) means the Government Flying Service.The Chief Executive is the Commandant of the Service. (71 of 1999 s. 3)
The Secretary may appoint an honorary Commander of the auxiliary section.
The Secretary may appoint a member of the auxiliary section to be the Senior Auxiliary Member.
The Senior Auxiliary Member is responsible to the Controller for the administration of the auxiliary section.
An applicant for enlistment in the auxiliary section shall—
apply to the Controller in writing in the form approved by the Controller including personal details and a declaration agreeing to be bound by the orders, rules and regulations from time to time applying to members of the auxiliary section;
furnish personal references as the Controller requires; and
be medically examined by a Government medical officer or by a medical practitioner approved by the Controller.
If the Controller considers an applicant suitable for appointment to a vacancy, an applicant shall declare that he will loyally serve the people of Hong Kong in the Service and, on making the declaration, the Controller shall appoint him to the auxiliary section.
The Controller shall enlist only persons over 17 and under 45 years into the auxiliary section.
A person under the age of 18 years shall produce the consent of his parent or guardian to his enlistment into the auxiliary section.
The Controller shall enrol an auxiliary member for an initial term of not more than 4 years.
An auxiliary member may apply for re-enlistment.
The Controller shall require an auxiliary member who applies for re-enlistment—
to sign a declaration to be bound by the orders, rules and regulations from time to time applying to members of the auxiliary section, in the form set by the Controller; and
to be medically examined.
The Controller has the discretion to re-engage an auxiliary member for a further term of not more than 4 years.
The Controller shall not re-engage an auxiliary member who is in receipt of a pension for service to the Service.
The Senior Auxiliary Member shall retire on reaching the age of 60 years or such later age as the Secretary may allow in a particular case.
Unless the Secretary otherwise directs, a member shall retire from the auxiliary section at 55 years of age.
The Senior Auxiliary Member may extend the term of a member of the auxiliary section for a period of not more than 2 years at a time after the age specified in subsection (2) and, in any event, not beyond the age of 60 years.
A member of the auxiliary section who retires after 10 years’ service may, on the recommendation of the Controller, be granted the privilege of wearing the uniform of the Service of such ranking on ceremonial occasions as the Controller specifies.
A member shall not, without the permission of the Controller—
publish or cause to be published, any matter or information; or
deliver a lecture or read a paper at a public meeting or broadcast on any subject,
relating to the operation of the Service, whether or not he is still a member.
A member shall not, when in uniform, attend any public meeting, save in the course of his duties.
The Controller may grant leave of absence from Hong Kong or from duty to an auxiliary member for such period as he may think fit.
A member shall before leaving Hong Kong inform the Service headquarters of his forwarding address, and he shall notify any change in such address.
A member shall be eligible for decorations, medals or clasps for efficiency, long service and good conduct instituted under any appropriate authority as far as they are applicable.
The Chief Executive may, by notice published in the Gazette, set the conditions for issue of decorations, medals or clasps for efficiency, long service and good conduct. (71 of 1999 s. 3)
The Controller shall issue equipment and uniforms to a member on loan in accordance with the scales laid down by the Director of Government Logistics. (L.N. 164 of 2003)
A member shall not wear any article of uniform with plain clothes.
A person who—
is not a member; or
is not authorized in writing by the Secretary,
wears any part of the uniform of the Service commits an offence and is liable to a fine at level 2 and to imprisonment for 6 months. (E.R. 5 of 2021)
An auxiliary member who is injured or contracts an illness when on call out or training shall—
be granted such free medical and hospital treatment as may be necessary to treat the injury or illness as directed by the Controller;
during the period of disability or illness, receive the pay and allowances at the rates which he is eligible to receive while undergoing training, until he recovers and is certified fit for duty by a Government medical officer, is granted a pension, gratuity or allowance for any residual disability or is invalided out of the Service.
If an auxiliary member is certified by a Government medical officer as unfit for further service, the Controller shall inform the member in writing that he has been invalided out of the Service and on receipt of the notice the member shall cease to be an auxiliary member.
The Secretary may amend the positions to which the terms “Senior Officer” and “Officer” apply and shall publish notice of the amendment in the Gazette.
For the purposes of section 20 of the Ordinance, the ranks of the Royal Hong Kong Auxiliary Air Force are transferred to the equivalent positions in the Service as specified in Schedule 2.
Senior Officer
